The Situation
A couple in their late 40s, each with children from previous marriages, needed wills that respected their shared assets while also protecting the interests of children on both sides. Previous attempts with general practitioners left them confused about what would happen to the family home.
What We Did
We conducted separate and joint sessions to understand each party's priorities. We drafted mutual wills with carefully worded clauses addressing the shared property, individual assets, and step-children. The binding element was explained at length before signing.
The Outcome
Both parties signed coordinated wills within four weeks. The couple told us they felt relieved knowing the house and personal assets were addressed clearly. They plan to review the documents in three years or sooner if circumstances change.
Trust Protection for a Single Parent's Young Children
The Situation
A single mother with two children under age 10 wanted to ensure her savings and a small apartment would be managed properly if something happened to her. She was concerned about the children receiving assets too early and spending them without guidance.
What We Did
We established a testamentary trust with a trusted family member as trustee. The trust was structured to release maintenance funds for schooling immediately, a partial distribution at age 21, and the balance at age 25. We also appointed a backup trustee in case the primary one could not serve.
The Outcome
The documents were completed in three weeks. The client said she felt a weight had been lifted, knowing her children's inheritance would be managed responsibly. She plans to update the trust terms as the children grow older and their needs change.
Multi-Property Succession for a Retiree
The Situation
A retired business owner held four properties across Selangor and Kuala Lumpur, each under different ownership structures. He wanted to distribute them among his three adult children while minimising potential disputes and transfer costs.
What We Did
We reviewed each title individually, identified that one was held as joint tenancy and three as sole ownership. We modelled different transfer approaches — testamentary transfer, inter-vivos trust, and direct transfer during lifetime — and presented a comparison of duty implications for each property.
The Outcome
The client chose a combination of approaches tailored to each property. Two were placed in a trust, one was transferred during his lifetime to his eldest daughter, and one was designated through his will. The planning process took about five weeks from initial review to final documentation.
